CP’s can create complex situations, particularly when they relate to “other agreements” being concluded and becoming unconditional where those “other agreements” have their own CP’s.


Always provide in your agreements for whose benefit CP’s are made. In most instances there are at least three possibilities, namely one of the parties, more than one of the parties and all of the parties.
